State Senate Passes Bill Banning ‘Predatory’ Yield Spread Premiums

The State Senate passed a bill yesterday banning “yield spread premiums,” which are payments given to mortgage brokers or lenders for directing borrowers to more expensive loans. The bill was sponsored by Senator Liz Krueger, who described yield spread premiums as a “predatory practice” that contributed to the foreclosure crisis.

“Yield spread premiums have created perverse incentives, driving irresponsible, dangerous activity in the mortgage market,” Ms. Krueger said. “It’s a predatory practice, and it’s passed time we banned it–permanently.” Read More

Eric Schneiderman Suing Three Major Banks For ‘Deceptive And Fraudulent Foreclosure Practices

State Attorney General Eric Schneiderman filed a suit today against Bank Of America, J.P. Morgan Chase and Wells Fargo for creating and using a private national mortgage electronic registry system called MERS to bring ” foreclosure proceedings en masse based on deceptive and fraudulent court submissions.”

“The banks created the MERS system as an end-run around the property recording system, to facilitate the rapid securitization and sale of mortgages,” Mr. Schneiderman said in a statement about the suit. Read More
